Terms and Conditions
These Terms and Conditions (''Terms'') govern your use of the Chef Brian's Kitchen website and your purchase and use of our digital products. Chef Brian's Kitchen is operated by Brian Lewis.
By using the website, placing an order, downloading a product, or using a product, you agree to these Terms. Do not use the website or purchase a product if you do not agree.
1. Eligibility
You must be at least 18 years old, or the legal age required to enter a contract where you live, to make a purchase. You agree that the information you provide at checkout is accurate.
2. Digital Products
Our products are delivered digitally as PDF files or other electronic files. No printed book, binder, meal planner, or physical product is included unless a product page clearly says otherwise.
You are responsible for using a device, internet connection, email address, and software capable of opening the delivered file.
3. Prices and Payments
Prices are shown in U.S. dollars unless stated otherwise. You authorize our payment processor to charge the payment method submitted at checkout for the products you select.
We may correct pricing, description, or technical errors before completing an order. If a completed order is affected by a material error, we may contact you, correct the order, or issue a refund.
4. Delivery
After successful payment, you will normally be directed to a download page and may also receive an email containing access information. Delivery may be delayed by an incorrect email address, spam filtering, internet problems, payment review, or technical issues.
Contact Brian@chefbrianskitchen.com if your file does not arrive. Do not purchase the same product again just to obtain another link.
5. Personal-Use License
Your purchase gives you a limited, non-exclusive, non-transferable, revocable license to download and use the product for your own personal, non-commercial use.
You may:
Save the file on your personal devices
Print a personal copy
Print reusable planning pages for your own household use
Use the recipes, ideas, and planning tools in your own kitchen
You may not:
Share the file with friends, relatives, groups, customers, or online communities
Email, upload, post, resell, rent, sublicense, or distribute the product
Remove copyright or ownership notices
Copy substantial portions into another product, website, course, book, or business
Use the product to create competing commercial materials
Make the file available through a shared drive, membership, file-sharing site, or public link
6. Intellectual Property
The website, product names, written content, recipes, teaching material, layouts, graphics, photographs, videos, branding, and downloadable files are owned by or licensed to Chef Brian's Kitchen and are protected by copyright, trademark, and other laws.
No ownership rights are transferred to you. Rights not clearly granted in these Terms are reserved.
7. Food Safety, Allergies, and Kitchen Responsibility
Cooking information is provided for general educational purposes. You are responsible for safe food handling, sanitation, proper storage, checking internal temperatures, avoiding cross-contamination, and deciding whether ingredients are suitable for you and the people you serve.
Recipes may contain or come into contact with common allergens. Always read ingredient labels and make substitutions appropriate for allergies, dietary needs, medical conditions, and personal preferences.
Cooking times are estimates. Appliances, ingredient sizes, cookware, elevation, and other conditions may change the time needed.
8. No Medical, Nutrition, or Professional Advice
Nothing on the website or in the products is medical, nutritional, dietary, legal, financial, or other licensed professional advice. Consult an appropriate professional regarding medical conditions, allergies, dietary restrictions, or other personal needs.
9. Results Are Not Guaranteed
We aim to provide practical, useful instruction, but we do not guarantee a specific cooking result, financial saving, health result, skill level, or personal outcome. Results depend on ingredients, equipment, attention, experience, and individual circumstances.
10. Third-Party Services and Links
The website and products may use or link to third-party services, including Systeme.io, Stripe,
YouTube, email providers, and other websites. We do not control those services and are not
responsible for their availability, content, security, policies, or actions.
11. Refunds
Refunds are governed by the Refund Policy posted on the website. The Refund Policy is incorporated into these Terms.
12. Website and Product Availability
We may change, correct, update, suspend, or discontinue website content, products, files, or features at any time. When reasonable, we may provide corrected or updated versions to existing buyers, but we do not promise permanent hosting or lifetime online access.
Customers should download and safely store purchased files after receiving them.
13. Disclaimer of Warranties
To the fullest extent allowed by law, the website and digital products are provided ''as is'' and ''as available.'' We do not make warranties that the website or products will be uninterrupted, error-free, suitable for every purpose, or produce a particular result.
14. Limitation of Liability
To the fullest extent allowed by law, Chef Brian's Kitchen and Brian Lewis will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the website, products, recipes, third-party services, or your use of them.
To the fullest extent allowed by law, total liability for a claim related to a purchased product will not exceed the amount you paid for that product.
Some laws do not allow certain limitations, so part of this section may not apply to you.

You agree to be responsible for claims, losses, or expenses arising from your misuse of the website or products, your violation of these Terms, or your violation of another person's rights, to the extent allowed by law.
16. Governing Law and Location
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Any legal action that is not required by law to be brought elsewhere will be filed in a state or federal court located in Pinellas County, Florida.
17. Severability
If one part of these Terms is found invalid or unenforceable, the remaining parts will continue in effect.
18. Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, and any product-specific terms shown at checkout, form the entire agreement regarding the website and digital products.
19. Changes to These Terms
We may update these Terms for future website use and purchases. The revised version will be posted with a new effective date.
